2.1 Service Availability

While we strive to provide uninterrupted service, we do not guarantee that our services will be available at all times. We may experience hardware, software, or other problems requiring maintenance, resulting in interruptions, delays, or errors.

2.2 Service Modifications

We reserve the right to modify, suspend, or discontinue any part of our services at any time with reasonable notice to affected users.

3. Terms of Use

3.1 Acceptable Use Policy

You agree to use our services only for lawful purposes and in accordance with these Terms. You agree not to use our services:

  • In any way that violates any applicable federal, state, local, or international law or regulation
  • To transmit any unauthorized advertising or promotional material or any form of spam
  • To impersonate or attempt to impersonate the Company, a Company employee, another user, or any other person or entity
  • In any way that infringes upon the rights of others or restricts or inhibits anyone's use or enjoyment of the Service
  • To introduce viruses, trojan horses, worms, logic bombs, or other malicious material
  • To attempt to gain unauthorized access to any portion of our services or any other systems or networks

Any content you transmit or post through our services must comply with these content standards:

  • Must not be unlawful, fraudulent, or deceptive
  • Must not infringe any copyright, database right, or trademark
  • Must not be threatening, abusive, or invade another's privacy

4. User Accounts

You are responsible for safeguarding the password and credentials you use to access our services. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

4.3 Account Termination

5. Payment Terms

5.1 Fees and Billing

By selecting a paid service, you agree to pay DostumAmigo the monthly or annual subscription fees indicated for that service. Payments will be charged on a pre-pay basis on the day you sign up for a paid service and will cover the use of that service for a monthly or annual subscription period as indicated.

5.2 Payment Methods

We accept the following payment methods:

  • Credit Cards (Visa, MasterCard, American Express)
  • Bank Transfers
  • PayPal
  • Other methods as specified during checkout

5.3 Automatic Renewal

Unless you notify us before the end of the applicable subscription period that you want to cancel a service, your subscription will automatically renew and you authorize us to collect the then-applicable annual or monthly subscription fee using any credit card or other payment mechanism we have on record for you.

5.4 Refund Policy

Refunds are handled on a case-by-case basis. Generally:

  • Monthly subscriptions: No refunds for partial months
  • Annual subscriptions: Pro-rated refunds may be available within 30 days
  • Custom projects: Subject to project-specific agreements
  • Hosting services: Subject to our Service Level Agreement

5.5 Late Payment

If payment is not received within 7 days of the due date, we reserve the right to suspend services until payment is made in full. Late payments may incur additional fees as specified in your service agreement.

6. Intellectual Property Rights

6.1 Our Intellectual Property

The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of DostumAmigo and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

6.2 Your Content

Our Service may allow you to post, link, store, share and otherwise make available certain information, text, graphics, or other material ("Content"). You are responsible for the Content that you post to the Service, including its legality, reliability, and appropriateness.

By posting Content to the Service, you grant us the right and license to:

  • Use, modify, and display the Content in connection with providing services
  • Store and backup your Content for disaster recovery purposes
  • Share Content with third parties as necessary to provide services (e.g., CDN providers)

6.3 Copyright Policy

We respect the intellectual property rights of others. If you believe that any material available on or through the Service infringes upon any copyright you own or control, please immediately notify us using the contact information provided below.

ℹ️ Note: All custom code, designs, and deliverables created specifically for you remain your property after full payment has been received, unless otherwise specified in a project agreement.

7. Prohibited Uses

You are prohibited from using the site or its content:

  • For any unlawful purpose or to solicit others to perform unlawful acts
  • To violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances
  • To infringe upon or violate our intellectual property rights or the intellectual property rights of others
  • To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
  • To submit false or misleading information
  • To upload or transmit viruses or any other type of malicious code
  • To collect or track the personal information of others
  • To spam, phish, pharm, pretext, spider, crawl, or scrape
  • For any obscene or immoral purpose
  • To interfere with or circumvent the security features of the Service

7.1 Consequences of Violation

Violation of any prohibited uses may result in immediate termination of services, legal action, and liability for any damages caused.

8. Disclaimers and Limitation of Liability

8.1 Disclaimers

The information on this website is provided on an "as is" basis. To the fullest extent permitted by law, this Company:

  • Excludes all representations and warranties relating to this website and its contents
  • Excludes all liability for damages arising out of or in connection with your use of this website

8.2 Limitation of Liability

In no event shall DostumAmigo, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your use or inability to use the service
  • Any unauthorized access to or use of our servers and/or any personal information stored therein
  • Any interruption or cessation of transmission to or from the service
  • Any bugs, viruses, trojan horses, or the like that may be transmitted through the service by any third party
  • Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content
⚠️ Maximum Liability: Our total liability to you for any damages shall not exceed the amount paid by you to DostumAmigo in the twelve (12) months preceding the claim.

8.3 Exceptions

Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the above limitations may not apply to you.

9. Termination

9.1 Termination by You

You may terminate your account at any time by:

  • Providing written notice to us at least 30 days in advance
  • Closing your account through the account settings (if available)
  • Ceasing all use of our services

9.2 Termination by Us

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including:

  • Breach of these Terms and Conditions
  • Non-payment of fees
  • Fraudulent or illegal activity
  • Violation of our Acceptable Use Policy
  • At our sole discretion for any other reason

9.3 Effect of Termination

Upon termination:

  • All rights granted to you under these Terms will immediately cease
  • You must immediately cease all use of our services
  • Any fees owed to us remain payable
  • We may delete your account and data after 30 days
  • We will provide data export assistance as per our data retention policy

10. Hosting Services Specific Terms

10.1 Server Resources

For hosting services, you agree to:

  • Not exceed allocated bandwidth, storage, or computing resources
  • Not use servers for cryptocurrency mining without permission
  • Maintain security of your server environment
  • Keep all software updated and patched
  • Not host illegal or prohibited content

10.2 Backup Policy

While we maintain regular backups of our infrastructure:

  • You are responsible for maintaining your own backups
  • We are not liable for any data loss
  • Recovery services may incur additional fees
  • Backup retention periods vary by service plan

10.3 Security Responsibilities

Our Responsibilities:

  • Physical security of data centers
  • Network infrastructure security
  • Host system security and updates
  • DDoS protection (basic level)

Your Responsibilities:

  • Application-level security
  • SSL certificate management
  • User access control
  • Content security and compliance

11. Service Level Agreement (SLA)

11.1 Uptime Guarantee

For hosting services, we guarantee the following uptime levels:

Network Connectivity 100% 5% per hour of downtime
Power Systems 100% 5% per hour of downtime
Cooling Systems 100% 5% per hour of downtime
DNS Services 99.9% 10% monthly credit if below
Server Hardware 99.9% Pro-rated credit for downtime

11.2 Exclusions

SLA credits do not apply to downtime caused by:

  • Scheduled maintenance (with 48-hour notice)
  • Customer actions or inactions
  • Force majeure events
  • Third-party software or services
  • DDoS or other attacks beyond our control

11.3 Support Response Times

Medium (Performance Issues) 8 hours 48 hours
Low (General Inquiries) 24 hours 5 business days

12. General Provisions

12.1 Governing Law

These Terms shall be governed and construed in accordance with the laws of Spain and the European Union, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

12.2 Dispute Resolution

Any dispute arising from these Terms shall be resolved through:

  1. Good faith negotiations between the parties
  2. Mediation in Las Palmas, Spain
  3. Binding arbitration under Spanish law
  4. As a last resort, litigation in the courts of Las Palmas, Spain

12.3 Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

12.4 Entire Agreement

These Terms constitute the entire agreement between us regarding our Service and supersede and replace any prior agreements we might have had between us regarding the Service.

12.5 Changes to Terms

We reserve the right to update these terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Effective Date" above.

12.6 Assignment

You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. We may assign these Terms at any time without notice to you.
